INDEMNITY

The hirer hereby indemnifies and holds the owner from and against all claims, action suits, costs and expenses, demands, including all legal costs and expenses, in any way arising out of the use of the equipment between the commencement of the hire and the return of the hired equipment to the owner. It doesn’t matter whether these claims are caused by negligence of the hirer or by the negligence of any other person whatsoever. It is the hirers responsibility of the hired equipment throughout the loan period, it is not the responsibility of the owner to ensure safe use for other people the hirer lends the equipment to

WARRANTY AND INSPECTION

1. The Hirer acknowledges that they have inspected the goods and
   (a) is satisfied that the goods are in clean condition and in good and substantial order and condition
   (b) is aware of the proper use for which the hired goods are designed for
2. The hirer hereby acknowledges that no warranty or condition expressed or implied is given by the owner as to the condition of the goods or as to the suitability or fitness of the goods for any purpose.

TERMS AND CHARGES

The Hirer will pay hire charges at the rate and in the manner specified. Starting from the commencement date and full duration of the hire until the hirer returns the goods to the premises of the owner.

In the event of the hirer requesting the owner to send/transport the goods to or from the owner’s premises. In addition to the initial hire charges, the hirer shall pay the owner all charges and expenses incurred by the owner in delivering/sending or collecting the goods if applicable.

Hire charges delivery and collection charges or other charges where applicable are payable prior to the commencement of the hire.
A $200.00 bond will be payable by the hirer prior to the commencement of the hire and will be returned, in full to the hirer from the owner once equipment hired is returned with no damages accrued.

The hiring is personal to the hirer only, the rights of the hirer are not assignable to any persons, person or any business or company whatsoever.

RETURN, DAMAGE, LOSS AND CLEANING

If the hired equipment is returned to the owner and they are not found to be in clean condition and/or not in acceptable and substantial order, the hirer shall pay to the owner the expenses and cost of restoring/repairing the goods to clean condition and/or acceptable and substantial working order.
The hirer accepts full responsibility to compensate the owner for the value of equipment or parts which may have been stolen, lost or damaged from the time of commencement of the hire or collected by the owner. This right shall not be prejudiced by or prejudice any other right under this agreement.
If the hired equipment returns to the owner damaged – the owner will retain bond paid by the hirer if damaged are casual from the hirer, not a fault of the hired equipment.

If the cost of the repairs to said damages, the hirer is liable for additional costs if the damages were caused by negligence or damage from the hirer.
The owner will not hold the hirer liable to the hiring charges while the goods are in service or repair unless the hirer fails to notify the owner within 24 hours of the failure/damage occurring.

MAINTENANCE AND BREAKDOWN

The Hirer will use the hired equipment in a skillful and proper manner and for the purposes for which such goods were designed.
The Hirer will Keep and maintain the goods in a clean condition and good and substantial working order.

In the event of a breakdown or a failure of the hired equipment, the hirer will not organise repairs. The equipment must be returned or sent back immediately by the hirer to the owner to ensure full repair and restoration of the equipment as soon as possible.

BREACH OF AGREEMENT AND TERMINATION

If the hirer makes default in the observance or performance of any of the above terms and conditions the owner may, without notice cease the hiring of the equipment from the hirer and take possession of the equipment. In the case of this occurrence, the hirer hereby authorises the owner, its employees and agents to enter upon any premises in the occupation of the hirer to search the premises and to remove & retrieve the hired equipment from their possession.

The owner shall not be liable to the hirer or any other person for any loss or damage to any person or property caused by the use and operation of the hired equipment.

Hired equipment not returned by the nominated due date will be treated as stolen property and legal proceedings will be undertaken to recover the stolen property and full value of the hired equipment will be paid by the hirer if the hired equipment wasn’t retrieved.
